People are often unsure about grandparents’ rights when they are denied access to their grandchildren
Unfortunately grandparents do not have any automatic rights regarding contact with their grandchildren. However, the family courts generally recognise that grandparents play an invaluable role in their grandchildren’s lives. It is very rare, therefore, that a court would refuse a grandparent access to their grandchildren, unless there has been any evidence of abuse or violence.
Whilst grandparents’ rights are limited, they can ask for permission (leave) to apply for a Contact Order. Before agreeing to this, the courts will consider the following:
The connection between applicant and grandchildren
The nature of the application for contact
Whether the application could in any way potentially harm the child’s well-being
If the courts decide in the grandparents’ favour, they can apply for a Contact Order to gain access to their grandchildren. If either parent objects to this, the grandparents will probably be asked to attend a full hearing where both sides can give their evidence. Seeking good legal advice at this stage is essential, because the grandparents will need to prove to the court that they have a meaningful, on-going relationship with their grandchildren, one which benefits the children’s lives significantly.
The court will consider all the child’s circumstances. They will only make an order where they feel it’s better for the child compared, with not making one. They might have to consider whether a grandparent’s continuing contact with the child could impact negatively on other family relationships. Again, only in rare instances will a court refuse grandparents access to grandchildren. Aramas Law has successfully helped many grandparents resolve disputes amicably and gain access to their grandchildren.
